University of Michigan's Race-Conscious Admissions to be Appealed

DETROIT
A federal judge's ruling upholding the University of Michigan's race-based admissions policy has been appealed to a higher court.
The Center for Individual Rights, a conservative legal organization based in Washington, filed the appeal late last month with the 6th U.S. Circuit Court of Appeals in Cincinnati. The center is challenging the university's affirmative action policies on behalf of two White students denied admission (see Black Issues, Dec. 7, 2000).
U.S. District Judge Patrick Duggan on Dec. 13 upheld the university's current undergraduate admissions policy.
The center argues that such policies favor less-qualified minority applicants. The university maintains that it has the right to take race into consideration and that failing to do so would cause the student body's minority population to dwindle.
